  • Replevin and attachment —These prejudgment remedies involve taking property in the debtor’s possession and applying it to settling the debt. In replevin, the sheriff hands the property over to the creditor, who must hold onto it until the final judgment. In attachment, the sheriff holds onto the property until the legal outcome.
  • Adversary proceedings — If the debtor has filed for bankruptcy, we can, if appropriate, lodge a complaint in bankruptcy court alleging that they incurred their debt fraudulently or they inappropriately transferred funds or property prior to their bankruptcy declaration.
  • Collection litigation — If necessary, we will go to court to demonstrate your right to payment and to obtain a judgment that will allow you to proceed with collection.
  • Post-judgment remedies —Once we obtain a judgment in your behalf, we will act to enforce the order. We can seek an order garnishing the debtor’s wages or attaching his or her bank accounts and other financial assets. We also work to obtain judgment liens so that you can be repaid through the sale of the debtor’s property.
