Creditor’s Rights

Experienced Pennsylvania Law Firm Helps Businesses Collect Debts

Diligent Pittsburgh attorneys assert the rights of creditors

Consumers as well as businesses sometimes fail to pay for goods or services they have already taken advantage, whether through neglect, deliberate avoidance or financial distress. Whatever the cause, you have rights as a creditor that must be asserted promptly and effectively. At Feldstein Grinberg Lang & McKee, P.C. in Pittsburgh, our attorneys help creditors throughout Pennsylvania hold debtors responsible for what they owe. We first aim to resolve issues outside of court. If no satisfactory solution is available, we pursue legal action to recoup your losses.

Determined lawyers represent service providers across various industries

No matter the size of your organization, our firm will take strategic, focused actions aimed to help you balance your accounts and keep your business running smoothly. We assess the specific needs and goals of your business and the type of debt involved. Our experienced attorneys represent small and large businesses in a wide range of industries, including:

  • Construction
  • Banking
  • Real Estate
  • Healthcare
  • Entertainment
  • Recreation
  • Hospitality
  • Technology

  • Transportation
  • Travel

We understand the laws governing debt collection and will advise you on the most efficient and timely course of action to recover the payments you’re entitled to.

Skilled litigators pursue legal action to reclaim property and settle bills

If a debtor does not respond to requests to pay what is owed, or fails to return property that is rightfully yours, our firm will provide assertive advocacy on your behalf. Beyond handling debt restructuring and loan workout arrangements, we can guide you through the following:

  • Replevin and attachment —These prejudgment remedies involve taking property in the debtor’s possession and applying it to settling the debt. In replevin, the sheriff hands the property over to the creditor, who must hold onto it until the final judgment. In attachment, the sheriff holds onto the property until the legal outcome.
  • Adversary proceedings — If the debtor has filed for bankruptcy, we can, if appropriate, lodge a complaint in bankruptcy court alleging that they incurred their debt fraudulently or they inappropriately transferred funds or property prior to their bankruptcy declaration.
  • Collection litigation — If necessary, we will go to court to demonstrate your right to payment and to obtain a judgment that will allow you to proceed with collection.
  • Post-judgment remedies —Once we obtain a judgment in your behalf, we will act to enforce the order. We can seek an order garnishing the debtor’s wages or attaching his or her bank accounts and other financial assets. We also work to obtain judgment liens so that you can be repaid through the sale of the debtor’s property.

While adhering to the federal Fair Debt Collection Practices Act (FDCPA) and Pennsylvania’s Fair Credit Extension Uniformity Act, we will assert your entitlement to fair terms of debt recovery.
